Today, the US Department of Justice filed a lawsuit challenging the constitutionality of Arizona’s anti-immigrant law that usurps federal authority and encourages racial profiling. The government will most likely attempt to delay the implementation of the law, currently set for July 29, by seeking an injunction.

The government contends that the Arizona law violates the supremacy clause of the Constitution, a legal theory that says federal laws override state laws. It is already illegal under federal law to be in the country illegally, although the punishment and enforcement tactics of the Arizona are much more severe.
Other organizations have also filed suit, such as the ACLU, NAACP, MALDEF and APALC, who charge that, in addition to usurping Federal authority, the bill will lead to rampant racial profiling and violates the 1st and 4th amendments to the US Constitution.
